1. Introduction

These Terms and Conditions ("Terms") govern your use of the Motivation Genie platform ("Service"), operated by Easy Home Networks (Pty) Ltd, trading as Motivation Genie ("we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Service Description

Motivation Genie is an automated document generation tool that assists users in creating motivation documents for South African firearm licence applications under the Firearms Control Act 60 of 2000.

Motivation Genie is a document automation tool and does not constitute a law firm, legal practice, or provider of legal advice. The documents generated by our Service are based on established legal frameworks and publicly available data. They are intended to assist you in preparing your application but do not replace the advice of a qualified legal professional. You are solely responsible for verifying the accuracy and completeness of all information contained in any document generated by the Service.

3. User Obligations

By using the Service, you represent and warrant that:

  • aYou are at least 18 years of age and a legal resident of the Republic of South Africa.
  • bAll personal information you provide to the Service is truthful, accurate, and complete.
  • cYou will not use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • dYou understand that the generated documents are tools to support your application and that the ultimate responsibility for any submission to the South African Police Service (SAPS) rests with you.
  • eYou will not reverse-engineer, decompile, or attempt to extract the source code or underlying algorithms of the Service.

4. Payment Terms

4.1 Fees

The Service is available for a once-off fee of R499.00 (four hundred and ninety-nine South African Rand), inclusive of VAT where applicable. This fee grants you access to generate and download your motivation document(s) for the application you have completed.

4.2 Payment Processing

All payments are processed securely through PayFast, a licensed South African payment gateway. We do not store your credit card or banking details on our servers. Payment processing is subject to PayFast's own terms and conditions.

4.3 Refund Policy

Due to the digital nature of the Service, once a motivation document has been generated and made available for download, the fee is non-refundable. If you experience a technical issue that prevents document generation after payment, please contact us at info@easyhomenetworks.co.za and we will resolve the matter promptly.

5. Intellectual Property

5.1 Your Documents

The motivation documents generated by the Service using your personal information belong to you. You are free to use, distribute, and submit them as part of your firearm licence application.

5.2 Our Platform

All intellectual property rights in the Service itself, including but not limited to its software, design, templates, algorithms, branding, and content (excluding user-generated documents), are and remain the exclusive property of Easy Home Networks (Pty) Ltd. You may not copy, reproduce, or redistribute any part of the Service without our prior written consent.

6. Limitation of Liability

No Guarantee of Approval: The use of our Service does not guarantee approval of your firearm licence application by SAPS or the Central Firearms Register (CFR). The decision to grant or decline a firearm licence rests solely with the Designated Firearms Officer (DFO) and the relevant authorities.

To the maximum extent permitted by South African law:

  • aWe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • bOur total liability in connection with the Service shall not exceed the amount you paid for the Service (R499.00).
  • cWe do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.
  • dWe are not liable for any decisions made by SAPS, the CFR, or any other authority based on documents generated by the Service.

7. Account Termination & Data Deletion

7.1 Your Right to Terminate

You may delete your account and all associated data at any time from your dashboard. Upon deletion, all personal information, application data, and generated documents stored on our servers will be permanently and irreversibly erased.

7.2 Our Right to Terminate

We reserve the right to suspend or terminate your account if we reasonably believe that you have violated these Terms, provided false information, or used the Service for unlawful purposes. We will notify you by email prior to any such action where practicable.

7.3 Inactive Accounts

Accounts that have been inactive for a period of 12 consecutive months may be subject to automatic deletion. We will attempt to notify you by email before any such deletion occurs.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

9. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms.

10. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
